Welcome to Erteqa. These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of all Erteqa digital platforms, including our website, mobile applications, products, services, and sub-brands such as EPIC, AARI, ABD, and the Kankoor App. By accessing or using any of our platforms, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

1. About Erteqa

Erteqa is a multidisciplinary Afghan organization providing management consulting, technology solutions, educational empowerment, and research services. We operate in alignment with Afghan national laws and global standards for transparency, data protection, and responsible technology development.

2. Acceptance of Terms

By accessing, browsing, or using any Erteqa platform, you confirm that you have read, understood, and accepted these Terms, as well as our Privacy Policy. We may update or revise these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

3. Eligibility

You must be at least 13 years old to use our platforms. If you are under 18, you must have permission from a parent, guardian, or school authority to participate in our programs. By registering, you represent that all provided information is accurate and complete.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use or breach. Erteqa reserves the right to suspend or terminate accounts that violate these Terms or pose security risks.

5. Services & Content

Our services include training, certification, digital tools, consultancy, and applications such as AARI, ABD, and Kankoor. Content provided is for informational and educational purposes. We strive for accuracy but do not guarantee that all information, materials, or reports are error-free. Erteqa retains the right to modify, suspend, or discontinue any service at any time without prior notice.

6. Intellectual Property Rights

All materials, trademarks, logos, design elements, data, reports, and digital content on Erteqa platforms are owned or licensed by Erteqa. Users may not copy, distribute, modify, or reproduce any material without prior written consent. You may download content for personal or educational use only, provided you retain all copyright and ownership notices.

7. User Conduct

You agree not to misuse Erteqa platforms or engage in any unlawful, harmful, or abusive activity. This includes unauthorized access, data scraping, distribution of malicious software, or impersonation of other users or staff. Users are expected to interact respectfully in all online and offline engagements associated with Erteqa programs.

8. Payment & Billing

Certain services, such as paid trainings or certifications, require payment. Prices are displayed in AFN, USD, or EUR depending on the program. Payment methods include bank transfer, online gateways, or donor sponsorship. All payments are final unless otherwise stated under a specific refund policy.

9. Refund & Cancellation

Refunds are processed only under written request and within the timeframe specified for each service. Training cancellations before start date may qualify for partial refunds. Projects or digital services are non-refundable once work has begun. Any exceptions will be handled at Erteqa’s discretion.

10. Third-Party Links & Services

Our platforms may contain links to third-party websites or tools. These are provided for convenience only. Erteqa is not responsible for the content, accuracy, or privacy practices of third-party entities. Accessing external sites is at your own risk.

11. Data Protection & Privacy

Use of Erteqa services is also governed by our Privacy Policy, which explains how we collect and process personal data. By using our platforms, you consent to our data practices as outlined in that policy.

12. Limitation of Liability

To the fullest extent permitted by law, Erteqa, its staff, and affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services. This includes but is not limited to loss of data, income, reputation, or opportunities. You agree to use Erteqa platforms at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Erteqa, its directors, employees, and partners from any claims, losses, damages, or expenses arising out of your misuse of our services, breach of these Terms, or violation of any law or third-party rights.

14. Suspension & Termination

Erteqa may suspend or terminate user access for misconduct, policy violation, or any action threatening the security or reputation of the organization. Upon termination, all rights granted to you under these Terms shall immediately cease, and you must delete or destroy any copies of materials obtained through our platforms.

15. Warranties Disclaimer

All services and content are provided “as is” and “as available”. Erteqa makes no warranties, express or implied, including but not limited to fitness for purpose, accuracy, or uninterrupted availability. We do not guarantee that our platforms will be error-free or continuously operational in all conditions.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Afghanistan. Any dispute arising under or in connection with this Agreement shall be resolved through amicable negotiation, and if unresolved, referred to the competent courts of Kabul, Afghanistan.

17. Dispute Resolution

In the event of a dispute, both parties agree to first seek informal resolution through written communication. If unresolved within 30 days, either party may pursue mediation or arbitration in accordance with Afghan civil procedure laws.

18. Force Majeure

Erteqa shall not be held liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to war, natural disasters, technical failures, or government restrictions.

19. Changes to Terms

Erteqa may revise these Terms periodically. Updated versions will be posted on this page with the effective date. Continued use of our platforms after updates indicates acceptance of the modified Terms.
